User Agreement

Important: This User Agreement is a legally binding contract between you and Beckham Brown Clark plc. Please read it carefully before opening or using your account. By using our services, you agree to be bound by this agreement.

1. About Your Account

This User Agreement ("Agreement") is a contract between you and Beckham Brown Clark plc ("BBC", "we", "us") and governs your use of any BBC account and the services we provide. It applies to all personal and business accounts held with BBC in England, Wales, Scotland, and Northern Ireland.

We may revise this Agreement from time to time. We will notify personal account holders at least 21 days before changes take effect, and business account holders at least 5 days in advance. Continued use of your account after the effective date constitutes acceptance of the changes. If you do not accept the changes, you may close your account.

2. Opening an Account

Personal Accounts

To open a personal account, you must:

  • Be an individual resident in the United Kingdom or eligible British territory.
  • Be at least 18 years of age (or 16 with parental consent for certain account types).
  • Provide accurate and complete personal information as requested during registration.
  • Successfully pass our identity verification and credit checks.
  • Agree to this User Agreement and all applicable supplementary terms.

Business Accounts

To open a business account, the business must be:

  • Incorporated, organised, or resident in the United Kingdom.
  • Legally registered with Companies House or equivalent regulatory body.
  • Represented by an authorised individual with authority to enter into this Agreement on behalf of the business.

We reserve the right to decline any application without providing a reason, subject to applicable equality and anti-discrimination laws.

3. Eligibility Requirements

You must provide accurate, complete, and up-to-date information at all times. You agree to promptly update any information that changes. We may ask you to re-verify your identity at any time to comply with our legal and regulatory obligations, including Anti-Money Laundering (AML) and Know Your Customer (KYC) requirements.

You must not open an account on behalf of someone else without proper authorisation, or provide false information in connection with your application.

4. Closing Your Account

You may close your account at any time by contacting us through Online Banking, our mobile app, by telephone, or in writing. Before closing, you must:

  • Withdraw or transfer all remaining balances.
  • Cancel any standing orders, direct debits, or recurring payment authorities.
  • Repay any outstanding overdrafts, loans, or credit facilities linked to the account.
  • Return any cards, cheque books, or devices issued in connection with the account.

We may close your account by giving you at least 60 days' written notice, except where required to act immediately by law or where you have materially breached this Agreement.

5. Sending and Receiving Payments

You may use your BBC account to send and receive payments via Faster Payments, CHAPS, BACS, and international SWIFT transfers where available. Payment instructions are generally irrevocable once submitted.

We may decline to execute a payment if:

  • You have insufficient funds or credit.
  • The payment would breach our legal or regulatory obligations.
  • We reasonably suspect fraud or money laundering.
  • The recipient account cannot be identified or is flagged by a fraud prevention agency.

Authorised Push Payment (APP) Scams

We participate in the UK Payment Systems Regulator's reimbursement scheme. If you are the victim of an authorised push payment scam, you may be eligible for reimbursement of up to £85,000 per claim, subject to the scheme's terms and any fraud or gross negligence on your part.

6. Fees and Charges

Applicable fees for our services are set out in our Fee Schedule, which is available in Online Banking and upon request. Key charges include:

Fees are subject to change with appropriate notice. All fees are inclusive of VAT where applicable.

7. Managing Multiple Currencies

Where your account supports multi-currency functionality, you may hold balances in supported currencies. Currency conversions are performed at the BBC exchange rate, which includes a margin above the interbank rate. The applicable rate is disclosed at the point of conversion.

BBC is not liable for losses resulting from exchange rate fluctuations.

8. Account Statements

We will provide monthly electronic statements via Online Banking. You may also request paper statements subject to the applicable fee. You are responsible for reviewing your statements promptly and notifying us of any errors or unauthorised transactions within 13 months of the transaction date.

9. Restricted Activities

You must not use your BBC account or our services to:

  • Breach this Agreement or any applicable law, regulation, statute, or ordinance.
  • Conduct, facilitate, or receive proceeds from any illegal activity, including money laundering, tax evasion, or financing terrorism.
  • Infringe the intellectual property, privacy, or other rights of any third party.
  • Transmit malicious code, conduct cyberattacks, or attempt to gain unauthorised access to any system.
  • Provide false, misleading, or inaccurate information to BBC or any third party in connection with your account.
  • Circumvent any security, fraud detection, or compliance systems operated by BBC.
  • Use your account to fund, receive, or hold funds related to gambling (where prohibited), adult content, counterfeit goods, or other restricted industries.
  • Allow any third party to use or access your account credentials without BBC's prior written consent.
  • Conduct transactions to or from sanctioned countries, entities, or individuals listed on UK, EU, or US sanctions lists.

We may suspend or terminate your account and report matters to relevant authorities if we believe you have engaged in any restricted activity.

10. Account Limitations and Holds

We may place holds on funds or impose limitations on your account where:

  • We are required to do so by a court order, regulatory directive, or law enforcement agency.
  • We detect or suspect fraudulent activity, unusual transaction patterns, or security risks.
  • You are in breach of this Agreement.
  • We need to conduct enhanced due diligence in compliance with AML regulations.

We will notify you of any restriction as soon as possible unless doing so would compromise a fraud investigation or is prohibited by law. Limitations will be lifted as soon as the underlying concern is resolved.

11. Unauthorized Transactions

An "Unauthorised Transaction" is one that you did not make or authorise. If you believe an unauthorised transaction has been made on your account:

  • Contact us immediately on 0800 096 9779 (24/7) or via Secure Message in Online Banking.
  • We will investigate and, where the transaction is confirmed as unauthorised, refund the amount within one business day.
  • You may be liable for up to £35 of losses from unauthorised transactions if you failed to keep your security credentials safe.
  • You may be fully liable if you acted fraudulently or with gross negligence.

Report all lost or stolen cards or compromised credentials immediately.

12. Error Resolution

If you believe an error has occurred on your account (e.g., an incorrect charge, a duplicate transaction, or a missing refund), please contact us within 13 months of the transaction date. We will investigate and, if an error is confirmed, correct it promptly and restore you to the position you would have been in had the error not occurred.

13. Communications

We will communicate with you electronically via email, in-app notifications, and Online Banking messages. You consent to receive regulatory and contractual notices electronically. It is your responsibility to maintain a current email address on your account and to regularly check your messages in Online Banking.

You may contact us by Secure Message through Online Banking, by calling 0345 300 0000, or by visiting any BBC branch.

14. Our Rights

We may suspend or terminate your account, take legal action, or exercise a right of set-off against any amounts you owe us. We also reserve the right to:

  • Refuse to execute any transaction that we believe violates applicable law or this Agreement.
  • Assign our rights and obligations under this Agreement to an affiliate or in connection with a merger or acquisition.
  • Update or modify our services and systems at any time, with appropriate notice where material changes affect your account.

15. Limitation of Liability

Nothing in this Agreement limits or excludes BBC's liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.

Subject to the above, BBC's total liability to you in any calendar year for losses arising from this Agreement (whether in contract, tort, or otherwise) shall not exceed the greater of:

  • £10,000; or
  • The total fees paid by you to BBC in the 12 months preceding the event giving rise to the claim.

BBC is not liable for indirect, consequential, or pure economic losses, loss of profits, or loss of data except where required by applicable law.

16. Intellectual Property

All intellectual property in BBC's website, app, content, logos, and branding is owned by or licensed to Beckham Brown Clark plc. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written consent.

By using our services, you grant us a limited, non-exclusive licence to process your data as described in our Privacy Policy. You do not grant us any rights over your intellectual property except as strictly necessary to provide the services.

17. Governing Law and Disputes

This Agreement is governed by and construed in accordance with the laws of England and Wales. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before commencing any legal proceedings, we encourage you to use our formal complaints procedure. If your complaint is not resolved to your satisfaction, you may refer it to the Financial Ombudsman Service:

18. Miscellaneous

  • Entire Agreement: This Agreement, together with our Privacy Policy, Cookie Policy, Fee Schedule, and any product-specific terms, constitutes the entire agreement between you and BBC.
  • Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions continue in full force.
  • Waiver: Failure to exercise any right under this Agreement does not constitute a waiver of that right.
  • Dormant accounts: Accounts with no transaction activity for 12 months may be classified as dormant. We will notify you before taking any action. Dormant account balances are transferred to the Reclaim Fund Ltd in accordance with the Dormant Assets Act 2022.
  • Language: This Agreement is made in English. Translated versions are provided for convenience only; in case of conflict the English version prevails.
